The only exception is if a clinical determination is made on a case-by-case basis that a \u201cmedically significant\u201d contraindication exists.<\/p>\n<p class=\"p1\">The law states, \u201cA physician and surgeon shall not automatically deny treatment or medication to a qualified patient based solely on a positive drug screen for tetrahydrocannabinol (THC) or report of medical cannabis use without first completing a case-by-case evaluation of the patient that includes, but is not limited to, a determination that the qualified patient\u2019s use of medical cannabis is medically significant* to the treatment or medication.\u201d It further states, \u201cThe use of medical cannabis that has been recommended by a licensed physician and surgeon shall not constitute the use of an illicit substance in the evaluation described.\u201d<\/p>\n<p><em><a href=\"https:\/\/staging.canorml.org\/wp\/medical-marijuana\/pain-doctors-discriminate-against-medical-marijuana-patients\/\">See background on the bill.<\/a><\/em><\/p>\n<p class=\"p1\"><strong>PHYSICIAN PROTECTIONS<\/strong><br \/>\nPhysicians are protected by the clause in the new law saying, \u201cNo physician and surgeon shall be punished, or denied any right or privilege, for having administered treatment or medication to a qualified patient within the requirements of this section and consistent with the standard of care.\u201d A similar exemption exists for physicians in Prop. 215, the Compassionate Care Act (<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=11362.5.&amp;lawCode=HSC\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">HSC 11362.5<\/span><\/a>) by which California voters legalized the use of medical marijuana in 1996.<\/p>\n<p class=\"p1\">Except for a single case where doctors were financially involved in a cannabis dispensary operation, the DEA has never taken action against doctors who recommend or allow the use of medical cannabis by their patients. In 2003, the US Supreme Court let stand a 9th Circuit Court of Appeals ruling that doctors have the right to recommend medical marijuana to their patients (<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-9th-circuit\/1343211.html\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\"><i>Conant v. Walters, 309 F.3d 629 (9th Cir. 2002<\/i><\/span><i>)<\/i><\/a>.<\/p>\n<p class=\"p1\"><strong>There is no law requiring pain clinics or doctors to screen out marijuana users.<\/strong> Medical marijuana patients are being caught up in a push to drug test in order to ensure compliance with prescription opiates. Many practitioners wrongly assume that they are obliged to screen out marijuana users as well.<\/p>\n<p class=\"p4\">*The \u201cmedically significant\u201d exemption in AB 1954 means that a physician and surgeon must make a clinical determination that the treatment or medication \u201cis contraindicated or is likely, or expected, to cause an adverse reaction or physical or mental harm to the qualified patient if administered or used in conjunction with THC or medical cannabis, based on the known clinical characteristics of the patient and the known characteristics and history of the patient\u2019s treatment or medication regimen.\u201d It can also mean the treatment or medication is expected to be ineffective, could worsen a comorbid condition, could decrease the capacity to maintain a reasonable functional ability in performing daily activities, or could pose a significant barrier to adherence to, or compliance with, the qualified patient\u2019s drug regimen or plan of care.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p5\"><strong>STUDIES AND POLICIES ON MEDICAL CANNABIS FOR PAIN<\/strong><\/p>\n<p class=\"p1\"><span class=\"s1\">A <a href=\"https:\/\/norml.org\/marijuana\/fact-sheets\/relationship-between-marijuana-and-opioids\" target=\"_blank\" rel=\"noopener\">great many studies<\/a> have found<\/span> that cannabis access is associated with reduced rates of opioid use and abuse, opioid-related hospitalizations, opioid-related traffic fatalities, opioid-related drug treatment admissions, and opioid-related overdose deaths. Knowledgeable specialists therefore regard medical marijuana as an exit, rather than a gateway, to narcotic abuse.<\/p>\n<p class=\"p6\"><span class=\"s2\">The <\/span><a href=\"https:\/\/cmcr.ucsd.edu\/index.php\" target=\"_blank\" rel=\"noopener\"><span class=\"s3\">California Center for Medicinal Cannabis Research<\/span><\/a><span class=\"s2\">, <\/span>established by the state legislature at University of California in 2000 to conduct controlled scientific studies of medical marijuana, has reported positive results in human clinical trials regarding chronic pain, in particular neuropathic pain.<\/p>\n<p class=\"p1\">In 2017, the <a href=\"https:\/\/nap.nationalacademies.org\/catalog\/24625\/the-health-effects-of-cannabis-and-cannabinoids-the-current-state\" target=\"_blank\" rel=\"noopener\">National Academy of Science released <span class=\"s1\">a major report on cannabis<\/span><\/a>, which concluded that chronic pain is one of the few conditions for which there is \u201cconclusive or substantial evidence\u201d for cannabis\u2019s effectiveness.<\/p>\n<p class=\"p1\">In 2019 the <a href=\"https:\/\/staging.canorml.org\/wp\/cma-house-of-delegates-votes-to-oppose-cannabis-pain-patient-discrimination\/\">California Medical Association House of Delegates voted to adopt <\/a><span class=\"s1\"><a href=\"https:\/\/staging.canorml.org\/wp\/cma-house-of-delegates-votes-to-oppose-cannabis-pain-patient-discrimination\/\">a recommendation<\/a> stating<\/span>, \u201cThat CMA oppose policies of health plans, health systems, and hospitals that have pain management programs that automatically eliminate patients who use therapeutic cannabis.\u201d<\/p>\n<p class=\"p1\">The <a href=\"https:\/\/www.publichealth.va.gov\/marijuana.asp\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">US Veteran\u2019s Administration policy<\/span><\/a> is not to deny treatment to patients who are participating in state medical marijuana programs.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"p1\"><strong>WHAT SHOULD PATIENTS AND DOCTORS DO?<\/strong><\/p>\n<p class=\"p1\">Doctors and health plans need to review their policies to be sure they are complying with state law. They can get training from the <a href=\"https:\/\/www.cannabisclinicians.org\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Society of Cannabis Clinicians <\/span><\/a>on proper use and dosage of cannabis medicines.<\/p>\n<p class=\"p1\"><strong>Patients who have experienced discrimination by their doctors because they use cannabis are advised to <a href=\"https:\/\/www.mbc.ca.gov\/Consumers\/file-a-complaint\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">file a complaint<\/span> with the CA Medical Board<\/a>. They should also <a href=\"mailto:info@canorml.org\"><span class=\"s1\">contact Cal NORML<\/span><\/a> to file a complaint and possibly take legal action.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p class=\"p7\"><strong>OTHER LEGAL PROTECTIONS FOR MEDICAL MARIJUANA PATIENTS IN CALIFORNIA<\/strong><\/p>\n<p class=\"p8\">\u2022 \u201cRyan\u2019s Law,\u201d (<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?division=2.&amp;chapter=4.9.&amp;lawCode=HSC\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">HSC 1649 &#8211; 1649.6<\/span><\/a>) passed in 2021, requires certain hospitals and health care facilities to permit the use of nonsmoked cannabis by patients with terminally ill diseases. Home health care patients can use vaporized or smoked cannabis, but not while a health care worker is present, or just before they arrive. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB302\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">SB 302<\/span> <\/a>(Stern), a 2023 bill, expanded these protections to seniors 65 and over with chronic medical conditions. The 2024 Health Care Omnibus bill <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB1511\" target=\"_blank\" rel=\"noopener\">SB 1511<\/a> specifically requires general acute care hospitals to allow terminally ill patients to use cannabis. <i>Also see: <\/i><a href=\"https:\/\/www.safeaccessnow.org\/ryanslaw_patientresources\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\"><i>Americans for Safe Access Patient\u2019s Guide to Ryan\u2019s Law<\/i><\/span><\/a><\/p>\n<p class=\"p8\">\u2022 <a href=\"https:\/\/oag.ca.gov\/system\/files\/initiatives\/pdfs\/15-0103%20%28Marijuana%29_1.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Prop. 64<\/span><\/a>, the Adult Use of Marijuana Act or AUMA, which California voters passed in 2016, protects the parental rights of medical marijuana patients under <span class=\"s1\"><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=11362.84.&amp;lawCode=HSC\" target=\"_blank\" rel=\"noopener\">HSC 11362.8<\/a>4<\/span>, which states, \u201cThe status and conduct of a qualified patient who acts in accordance with the Compassionate Use Act shall not, by itself, be used to restrict or abridge custodial or parental rights to minor children in any action or proceeding under the jurisdiction of family or juvenile court.\u201d In addition, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2595\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">AB 2595<\/span><\/a> (Jones-Sawyer, 2022) requires the State Department of Social Services to treat a parent\u2019s use of cannabis in the same manner as alcohol or legally prescribed medication under <span class=\"s1\"><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=328.2.&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">WIC 328.2<\/a>.\u00a0<\/span><\/p>\n<p class=\"p8\">\u2022 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220SB1186\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">SB 1186<\/span><\/a> (Wiener &#8211; 2022) requires cities and counties to permit deliveries of medical cannabis in their jurisdiction, as of January 1, 2024. Local governments have amended their ordinances to comply with the new law. <i>Also see:<\/i> <span class=\"s1\"><i><a href=\"https:\/\/www.omarfigueroa.com\/how-california-senate-bill-1186-will-expand-medical-delivery-statewide\/\" target=\"_blank\" rel=\"noopener\">How California Senate Bill 1186 Will Expand Medical Delivery Statewide<\/a>. <\/i><\/span><\/p>\n<p class=\"p8\">\u2022 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2188\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">AB 2188<\/span><\/a> (Quirk, 2022) outlaws employment discrimination due to testing for inactive THC metabolites in urine or hair by most California employers. Employees may not be impaired on the job, and may be subject to an oral swab or blood test.<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB700\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">SB 700<\/span><\/a> (Bradford, 2023) bans questions about past marijuana use by most employers in California. <a href=\"http:\/\/www.CaNORML.org\/Employment_Rights\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\"><i>Read more.<\/i><\/span><\/a><\/p>\n<p>\u2022 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201520160AB258\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">AB 258<\/span><\/a> (Levine, 2015) outlaws discrimination against medical marijuana patients who need organ transplants under <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=7151.36.&amp;lawCode=HSC\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">HSC 7151.36<\/span><\/a>.<\/p>\n<p class=\"p8\">Medical marijuana patients are often unable to find places where they can safely use their medicine.
